This paper reports on-going work in the eSCAPE Project (Esprit Long Term Research Project 25377) directed to the research and development of electronic landscapes for public use. Our concern here is to elucidate a sociologically informed approach towards the design of electronic landscapes or virtual worlds. We suggest — and demonstrate through ethnographic studies of virtual technologies at a multimedia art museum and information technology trade show — that members sense of space is produced through social practices tied to the (...) accomplishment of activities occurring within the locations their actions are situated. Space, in other words, is socially constructed and shaped through members’ practices for accomplishing situated activities. We explicate, by practical examples, an approach to discovering social practices in and through which a sense of space is constructed and outline how such understandings may be used to formulate requirements for the design of electronic landscapes. In explicating our ethnographically informed approach, we outline how future technologies may bedeveloped through the situated evaluation of experimental prototypes in public use. (shrink)

National Action Plans on business and human rights are a growing phenomenon. Since 2011, 42 such plans have been adopted or are in-development worldwide. By comparison, only 39 general human rights action plans were published between 1993 and 2021. In parallel, NAPs have attracted growing scholarly interest. While some studies highlight their potential to advance national compliance with international norms, others criticise NAPs as cosmetic devices that states use to deflect attention from persisting abuses and needed regulation. In response to (...) wider critiques of international human rights norms, and their failure to exact universal state compliance, experimentalist governance theory highlights the dynamic, dialogic and iterative character of human rights implementation as well as the role of stakeholders. In this article, we apply experimentalist governance theory to evaluate the role and character of business and human rights NAPs. Rather than attempting to evaluate NAPs’ ultimate consequences for rights-holders, which appears premature, we focus on NAPs processes. Specifically, we analyse NAPs processes in twenty-five states against five experimentalist governance criteria relating to stakeholder participation; agreement on a broad problem definition; local contextualisation; monitoring and peer review and periodic revision and learning. According to our findings, NAPs on business and human rights in most states demonstrate resemblance to the traits of experimentalist governance. In particular, our analysis points to the emergence of relatively sophisticated and demanding institutional governance mechanisms within NAPs — including the institutionalisation of complex deliberative processes. Nevertheless, our paper also identifies some significant shortcomings in NAPs, related to the lack of inclusion of vulnerable groups and the lack of explicit indicators and targets. (shrink)

The ‘no-suicide contract’ is a frequently utilized tool in both the assessment and dispersal of suicidal patients. However, little attention has been given to questioning whether suicidal persons are able to give informed consent to enter such a contract. This article utilizes both the existing literature on no-suicide contracts and the results of recent research into the effects of this tool, to examine whether its use is consistent with the legal and ethical doctrine of informed consent. Particular attention is given (...) to issues of competence, fullness of information, voluntariness and paternalistic intervention when no-suicide contracts are used. This analysis finds the tool to be problematic and suggests that individual patients’ ability to give informed consent about a no-suicide contract needs to be carefully considered by clinicians. Substantial medical evidence shows that about half of ovarian cancers originate in the fallopian tube. Some medical organizations and clinical articles have suggested opportunistic salpingectomy to reduce the risk of ovarian cancer in patients at average risk of developing it. This entails removing the fallopian tubes at the same time as another procedure that would occur anyway. The authors argue that the principles of totality and double effect can justify such salpingectomies, even though there is a low incidence of ovarian (...) cancer. Since screening tools for ovarian cancer are ineffective and treatment options are poor, the good effect of reducing the risk of death from this type of ovarian cancer can be proportionate to the bad effects of the minor increase in surgical risk over the other procedure, the unintended side effect of infertility, and the removal of normally functioning tissue. The authors conclude that it is within the purview of a patient and physician to determine whether the benefits are proportionate to the risks in a particular case. (shrink)

In Why Not Socialism? G.A. Cohen articulates a version of socialism characterized by two values—equality and community—but, being a value pluralist, Cohen is not sanguine about the practical consistency of those values. This paper deals with the relationship between Cohen's formulations of the values of community and equality. I argue that Cohen faces a dilemma: either community and equality are not even in principle consistent, or else they are conceptually compatible. I argue, moreover, that despite the cost to Cohen's value (...) pluralism of accepting the dilemma's second horn, it carries the felicitous consequence of obviating the contingent conflicts between community and equality about which Cohen is concerned. Finally, I suggest that accepting the second horn—that is, the grounds of compatibility between community and equality—is helpful in resolving a puzzle recently raised by John Roemer about Cohen's picture of socialism. Written in response to what he recognizes as the problematic philosophical underpinnings of “orthodox research ethics,” Alex John London’s For the Common Good reimagines what is called for in any effort to create a better system of oversight and regulation in biomedical research. London weaves a common thread — justice — through this historical and critical account of the practice of research ethics and its organization of stakeholders, institutions and regulations. By introducing the idea of “a common good” London (...) reframes the narrative and responsibilities of the research ethics field to demonstrate that scientific research and regard for the rights and welfare of individuals are not mutually exclusive. This impressive monograph encourages its readers to push past the limitations of traditional research ethics to consider the context in which the discipline is embedded. That is, rather than settling for analysis at the level of researchers and research participants alone, London encourages us to expand our inquiry to encompass a wider array of stakeholders who co-labor in the social undertaking of biomedical knowledge production. London accomplishes the difficult task of upstream analysis — turning his attention to the conditions and assumptions which create ethical dilemmas rather than applying a retrospective ethical salve to injuries near-guaranteed by a broken system. As opposed to the limited domain of orthodox research ethics (researchers, participants, and the institutional bodies which regulate interaction between the two) London also considers the role and contributions of affected communities, pharmaceutical firms, philanthropic organizations, and journal editors among others. Macmurray provides a conceptual and personal reference point around which we can locate a tradition of social humanism that unfolds from the British idealists to the communitarians. Some communitarian themes appear in the thought of the idealists: these include a vitalist analysis of behaviour, a 'thick' view of the person, and a positive concept of freedom defined in relation to others. Macmurray developed these themes and introduced others largely as a result of reworking idealism so as to come to terms (...) with the crisis of reason associated with the First World War. He rejected objective idealism with its concept of absolute mind for a personal idealism that incorporated an action-based metaphysics. Doing so prompted him to adopt other communitarian themes: these include an appeal to friendship and love, a contrast between society and community, and an appeal to religion to transcend the limits of justice. While contemporary communitarians have inherited much from philosophers such as Macmurray, they have also developed the tradition of social humanism. Philosophers such as Sandel, Taylor and Walzer have done so through grappling with the implications of multiculturalism for the idea of a cosmopolitan community. Ethical socialists like Tony Blair and Raymond Plant have done so through grappling with issues such as a decline in solidarity as it influences the welfare state. (shrink)
